Insurance Law in Nepal

The Nepal Insurance Authority (NIA) — formerly known as Beema Samiti (Insurance Board) — is the autonomous regulatory body overseeing Nepal's insurance industry. Established under Section 3 of the Insurance Act, 2079, it has perpetual succession and operates under the Ministry of Finance. NIA is responsible for licensing insurance companies, formulating directives and regulations, enforcing compliance, protecting policyholder rights, and conducting studies for industry development. It is a founding member of the International Association of Insurance Supervisors (IAIS).

Insurance in Nepal is classified into:

• Life insurance — covers death, endowment, whole life, term life, and pension plans (14 companies)
• Non-life (general) insurance — covers property, motor, fire, marine, health, accident, and liability (14 companies)
• Reinsurance — insurers purchase insurance from reinsurers to mitigate risk (2 domestic reinsurers)
• Micro insurance — small-value policies for low-income populations (2 micro life + 3 micro non-life companies)

As of 2024, there are approximately 38 licensed insurance companies in Nepal.

To establish an insurance company:

• Register a company at the Office of Company Registrar with insurance business as its objective
• Meet minimum paid-up capital requirements set by NIA (varies by insurance type — life, non-life, reinsurance)
• Apply to NIA for an insurance business license
• Submit required documents: MOA/AOA, business plan, projected financials, details of promoters and directors
• NIA evaluates solvency, capital adequacy, management competency, and infrastructure
• Comply with corporate governance standards mandated by the Act

The Insurance Act, 2079 establishes fundamental principles:

• Utmost good faith (Uberrima Fides) — both parties must disclose all material facts
• Insurable interest — policyholder must have a financial interest in the insured subject
• Indemnity — insurer compensates only the actual loss (non-life)
• Subrogation — insurer assumes the right to recover from the party that caused the loss
• Contribution — multiple insurers share proportional liability
• Proximate cause — loss must be caused by an insured peril
• Mitigation — policyholder must take reasonable steps to minimize loss

The general claims process:

• Notify the insurance company immediately after the loss/event
• Submit a written claim with supporting documents (policy, proof of loss, bills, police report if applicable)
• Insurance company assigns a surveyor to assess the claim
• Surveyor submits assessment report
• Insurance company reviews and approves/rejects the claim
• If approved, settlement payment is made as per policy terms

If the claim is rejected or the settlement is unsatisfactory, the policyholder can file a complaint with NIA or pursue legal remedies.

The Rastriya Beema Sansthan (RBS) — Nepal's state-owned insurer established in 2025 BS — has been separated into two entities under the Insurance Act 2079: Rastriya Jeewan Beema Company Limited (life) and Rastriya Beema Company Limited (non-life). Both must convert to companies under the Companies Act, increase paid-up capital, and float shares to the public. This reform brings the state insurer under the same regulatory framework as private insurers.
