Consumer Protection Law in Nepal

The Consumer Protection Act 2075, Section 6, guarantees six fundamental consumer rights:

• Right to Safety — protection against hazardous goods and services
• Right to Information — right to know price, quality, ingredients, expiry date, and origin
• Right to Choose — freedom to select from competitive options without coercion
• Right to be Heard — right to express opinions and have complaints addressed
• Right to Redressal — right to compensation for losses caused by defective goods or unfair practices
• Right to Consumer Education — right to knowledge about consumer protection mechanisms

You can file a consumer complaint through several channels:

• DCSCP — submit written complaint with evidence to the Department of Commerce, Supplies and Consumer Protection
• Inspection Officer — district-level officers who investigate and decide within 15 days
• Consumer Court — specialized court for consumer cases (established February 2022)

• Nepal Police — for criminal offences like food adulteration or selling harmful products

The Consumer Court is a specialized court established in February 2022 (8 Falgun 2078 BS) upon a Supreme Court order. It has jurisdiction equivalent to a District Court and handles cases involving fraud, substandard goods, price manipulation, and unsafe products. The court can award both civil compensation and criminal penalties. If the Consumer Court is dissolved, pending cases transfer to the relevant District Court.

Yes. Under Section 14 of the Consumer Protection Act 2075, consumers have a legal right to return goods: 7 days for perishable goods (food, dairy) and 15 days for non-perishable goods (electronics, clothing). The goods must be in returnable condition and a receipt is required. Sellers cannot enforce "goods once sold cannot be returned" policies — these are not legally valid.

Under the National Penal Code 2074 (Sections 107–110): selling adulterated food carries imprisonment up to 3 years or fine up to NPR 30,000 or both; selling expired goods carries up to 2 years imprisonment or NPR 20,000 fine; selling goods harmful to health carries up to 3 years or NPR 30,000. The Consumer Protection Act 2075 also empowers the Consumer Court and Inspection Officers to impose additional fines and order compensation.

Yes. The Consumer Protection Act 2075 applies equally to e-commerce platforms and online sellers. The Electronic Commerce Act, 2081 (2024) further mandates that online businesses display accurate product information, honor return policies, protect consumer data, and provide grievance redressal. Online fraud can also be reported to the Cyber Bureau Nepal Police.

Yes. False or misleading advertising is a prohibited trade practice under Section 9 of the Consumer Protection Act 2075. If an advertisement contains claims that are untrue or exaggerated, the consumer can file a complaint with the DCSCP, Inspection Officer, or Consumer Court. The seller may face fines, and repeat offences can result in business closure.

Inspection Officers are district-level officials appointed under the Consumer Protection Act 2075 to investigate consumer complaints. They receive complaints, issue notices to sellers, conduct investigations, examine witnesses, and must decide cases within 15 days of receiving the defendant's reply. Their decisions can be appealed to the Director General of DCSCP. A 50% cash deposit of the fine is required when filing an appeal.

Evidence for filing a consumer complaint includes:

• Purchase receipt or invoice
• Photographs of the defective product or packaging
• Copy of the advertisement (if false advertising claim)
• Product labeling showing missing or incorrect information
• Medical reports (if health was affected)
• Written correspondence with the seller
• Witness statements (if applicable)

Under the Consumer Protection Act 2075, if a complaint is found to have been filed with malicious intent, the complainant may be fined NPR 1,000. This provision is designed to prevent misuse of the complaint system while still encouraging genuine consumers to report violations without fear.

Yes. The Consumer Court and Inspection Officers have the power to order compensation to aggrieved consumers after evaluating the actual losses suffered. Compensation can cover the cost of the defective product, medical expenses (if health was affected), and additional damages. Both the Consumer Protection Act 2075 and the National Penal Code 2074 provide for compensation in consumer cases.

Yes. Hoarding essential goods (rice, lentils, oil, fuel, etc.) to create artificial shortages and price increases is a prohibited trade practice under Section 9 of the Consumer Protection Act 2075. It is also a criminal offence under the National Penal Code. Hoarded goods can be confiscated, and the hoarder faces criminal prosecution, fines, and potential imprisonment.

The Maximum Retail Price (MRP) is the highest price at which a product can be sold to consumers. Under the Consumer Protection Act and related regulations, all products must display the MRP on their packaging. Selling above MRP is a violation of consumer rights and is punishable by fine. Consumers can report MRP violations to the DCSCP or Inspection Officer.

Yes. During divorce proceedings, joint purchases made during marriage (vehicles, electronics, property) may become disputed during property partition. Consumer rights such as refund and return can affect the valuation of disputed assets. Medical malpractice claims are also consumer protection cases where healthcare is treated as a service under the Act.
